Terms of Service

1. Introduction and Acceptance

Atlas is an artificial-intelligence powered tool offered by Pocket Entertainment Ventures Private Limited ("Pocket FM," "we," "us," or "our") that allows you to submit literary work in the form of texts such as a script developing into stories, or other written material and generate a translated and locale-adapted version of that text.

These Atlas Terms of Services (the "Atlas Terms") govern your access to and use of Atlas, including any related features, content, and functionality.

By accessing or using Atlas, including by submitting any Input (as defined below), generating any Output (as defined below), or trying any Sample Script (as defined below) you acknowledge that you have read, understood, and agree to be bound by these Atlas Terms and by the Pocket FM Terms (defined in Section 2). If you do not agree, you must not access or use Atlas.

Throughout these Atlas Terms, "you" and "your" refer to the individual accessing or using Atlas.

2. Relationship to the Pocket FM Terms (Supplemental Terms)

2.1 Supplemental terms. These Atlas Terms are supplemental to, and are incorporated into, the Pocket FM Terms of Service available in the Pocket FM Terms of Service (the "Pocket FM Terms"), together with the Atlas Privacy Notice and any other policies, guidelines, or terms referenced in them. The Pocket FM Terms continue to apply to your use of Atlas except as expressly modified by these Atlas Terms.

2.2 Order of precedence. In the event of any conflict or inconsistency between these Atlas Terms and the Pocket FM Terms, these Atlas Terms will prevail and control solely to the extent of such conflict or inconsistency and solely with respect to your use of Atlas. In all other respects, the Pocket FM Terms remain in full force and effect.

3. Eligibility - Users Must Be 18 or Older

3.1 Minimum age and Representation. Atlas is intended and made available only for users who are at least eighteen (18) years of age, or the age of legal majority in their jurisdiction of residence if higher. By accessing or using Atlas, you represent and warrant that you have the legal capacity and authority to enter into and comply with these Atlas Terms.

3.2 No use by minors. Atlas is not directed to, and may not be used by, anyone under 18. We do not knowingly provide Atlas to, or collect information from, minors. If we become aware that a user is under 18, we may suspend or terminate that user's access to Atlas.

4. Description of the Service

4.1 What Atlas does. Atlas accepts text Input that you submit and generates Output that translates and/or adapts that Input into a different language, locale, dialect, or cultural context using one or more underlying AI models.

4.2 Supported locales. The languages and locales supported by Atlas are currently limited and are identified within the product. Pocket FM may, at its sole discretion and at any time, add, modify, restrict, suspend, or remove supported languages, locales, features, or functionality, with or without prior notice. We do not guarantee that any particular language or locale is or will remain available or will be added in the future.

4.3 Availability. Atlas is provided on an "as available" basis. It may be changed, interrupted, suspended, limited, or discontinued at any time, as described in Section 13.

4.4 Third-party technology. Atlas may be powered, in whole or in part, by third-party models, software, or infrastructure. Your use of Atlas is also subject to the applicable terms and usage policies of these third-party providers, including Anthropic's Usage Policy and Google's Generative AI Prohibited Use Policy, each as updated from time to time, and you agree not to use Atlas in any manner that would violate those terms or policies. Pocket FM may add, change, or replace these models or providers at any time and without notice.

5. Atlas Is an Inference Layer Only

5.1 Inference only. Atlas operates solely as an inference layer. When you submit Input, Atlas passes that Input to an underlying AI model and returns the Output that the model generates.

5.2 No verification or human editorial review. Except as expressly stated in writing, Atlas does not independently verify, fact-check, proofread, edit, quality-check, or apply human editorial or professional review to any Input or Output, and does not assess Input or Output for legal, regulatory, or cultural compliance. See the AI Output Disclaimer in Section 11.

6. Your Content: Input and Output

6.1 Definitions. "Input" means the text and other material you submit to Atlas. "Output" means the translated and/or adapted result that Atlas returns to you based on your Input. Input and Output are together referred to as your "User Content." User Content does not include Sample Scripts or Sample Adaptations, which are governed by Section 7.

6.2 Ownership of Output. As between you and Pocket FM, and to the extent permitted by applicable law, you retain all the rights you hold in your Input, and Pocket FM shall not claim ownership of the Output generated from your Input, subject to these Atlas Terms (including the license in Section 6.4 and the provisions on Sample Scripts in Section 7). This Section 6.2 does not apply to Sample Scripts or Sample Adaptations.

6.3 No exclusivity or guaranteed originality of Output. Because of the nature of generative AI, Output is not guaranteed to be unique. Other users may submit similar Input and receive the same or similar output, and your rights in your Output do not extend to the independently generated output of others. Pocket FM does not represent or warrant that any Output is original, accurate, or free from infringement, or that it can be protected under the applicable intellectual-property laws. You are solely responsible for determining whether your Output is suitable and lawful for your intended use.

6.4 Limited license to operate Atlas. You grant Pocket FM a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display back to you, reproduce, and create the translated or adapted derivative (that is, the Output) of your User Content, solely to the extent necessary to operate, provide, secure, maintain, troubleshoot, and support Atlas for you and to comply with applicable laws. This license does not permit Pocket FM to use your User Content to train or develop AI or machine-learning models, or to use it for broader Pocket FM business purposes, as further described in Section 8.

6.5 Your responsibility for User Content. You are solely responsible for your Input and for your use of any Output, including for reviewing and evaluating the accuracy, legality, quality, and appropriateness of any Output before relying on, publishing, distributing, or otherwise using it.

6.6 Your representations and warranties. You represent and warrant that: (a) you own or have obtained all rights, licenses, consents, and permissions necessary to submit your Input to Atlas and to authorize its processing, to generate Output; (b) your Input, and Pocket FM's processing of it as contemplated by these Atlas Terms, do not and will not infringe, misappropriate, or violate any third party's intellectual-property, privacy, publicity, or other rights, or any applicable law; and (c) your Input and your use of Atlas comply with these Atlas Terms, including the Acceptable Use Policy in Section 10.

7. Sample Scripts and Pocket FM Materials

7.1 Sample Scripts. Atlas may make available sample scripts, stories, prompts, excerpts, or other text for you to try or evaluate the Service (each, a "Sample Script").

7.2 Pocket FM ownership. Pocket FM (and/or its licensors) owns and retains all right, title, and interest, including all intellectual-property rights, in and to the Sample Scripts. No ownership of, or other rights in, the Sample Scripts shall be transferred to you.

7.3 Sample Adaptations are Pocket FM property. Any translation, adaptation, derivative work, or other Output that is generated from, based on, or derived from a Sample Script (each, a "Sample Adaptation") is and shall remain the sole and exclusive property of Pocket FM. To the extent you acquire any right, title, or interest in any Sample Adaptation, you hereby irrevocably and unconditionally assign all such right, title, and interest to Pocket FM, and waive any moral rights in it to the maximum extent permitted by law. The Output-ownership provisions of Section 6.2 do not apply to Sample Scripts or Sample Adaptations.

7.4 Permitted use. Sample Scripts and Sample Adaptations are provided on a non-exclusive license to you, solely limited to allow you to evaluate and demonstrate Atlas for your personal, non-commercial and Trial Use only. "Trial use" means using the Sample Scripts only to test the functionality and capabilities of Atlas before you sign in. You may not copy, reproduce, distribute, publicly display or perform, broadcast, sell, license, sublicense, commercially exploit, or create works for distribution from the Sample Scripts or Sample Adaptations, except as Pocket FM expressly authorizes in writing.

7.5 No implied rights. Except for the limited evaluation use expressly described above, no license or right in the Sample Scripts or Sample Adaptations is granted to you, whether by implication, estoppel, or otherwise.

8. Data Use, No Training, and Privacy

8.1 No use for AI training. Pocket FM does not use your Input or Output to train, fine-tune, or develop any artificial-intelligence or machine-learning models.

8.2 Limited storage and use. Your Input and Output are stored and processed only to the extent necessary to provide and operate Atlas for you, for instance, to generate Output, to return and make Output available to you, and to operate, secure, maintain, troubleshoot, and support the Service, and to comply with applicable laws. Your Input and Output are retained as per the terms of the Atlas Privacy Notice, after which they are deleted or de-identified in the ordinary course (subject to routine backups and any legal-hold or record-keeping obligations).

8.3 No broader business use. Pocket FM does not use your Input or Output for broader Pocket FM business purposes including advertising, building user profiles, selling data, or product analytics unrelated to operating Atlas, except as necessary to provide the Service to you or to comply with applicable laws.

8.4 Exclusions. For clarity, this Section 8 does not apply to, and does not restrict, Pocket FM's use of: (a) Sample Scripts and Sample Adaptations (Section 7); and (b) Feedback (Section 9).

8.5 Operational metrics (optional). Pocket FM may generate and use limited aggregated or de-identified operational metrics that do not contain, and cannot reasonably be used to identify, you or the content of your Input or Output (for example, counts of requests, error rates, or latency), solely to monitor, operate, and improve the reliability and security of Atlas.

8.6 Privacy. Pocket FM's collection and handling of personal data in connection with Atlas is described in the Atlas Privacy Notice available at Atlas Privacy Notice. You should not submit personal or sensitive information to Atlas; see the Acceptable Use Policy in Section 10.

9. Feedback

If you choose to provide Pocket FM with any feedback, suggestions, ideas, or recommendations regarding Atlas ("Feedback"), you grant Pocket FM a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, and transferable license to use, reproduce, modify, and otherwise exploit the Feedback for any purpose, without any obligation or compensation to you. Feedback is not your confidential information. You shall not include any Input, Output, or personal or sensitive information within your Feedback.

10. Acceptable Use Policy

This Acceptable Use Policy applies to all use of Atlas and to all Input and Output. You agree that you will not use Atlas, and will not submit any Input or use any Output, to do, attempt, facilitate, or enable any of the following:

• No infringing material. Infringe, misappropriate, or violate any third party's intellectual-property rights (including copyright, trademark, patent, or trade secret), rights of publicity or privacy, or any other rights; or submit any material that you do not have the necessary rights, licenses, or permissions to submit or process.
• No illegal or unlawful activity. Violate any applicable law, regulation, sanctions regime, or court order, or promote, facilitate, or engage in any illegal or unlawful activity.
• No personal or sensitive information. Submit personal data or sensitive personal information, whether your own or another person's, including names combined with identifiers, government-issued identification numbers, financial-account or payment/card details, health or medical information, biometric data, precise geolocation, account credentials, or other special-category or sensitive data. You should not input such information into Atlas; if you nonetheless do so, you are solely responsible for ensuring that you have a lawful basis and all required consents, and for any resulting consequences.
• No content harmful to minors. Create, generate, request, or distribute any content that sexually exploits, abuses, or endangers minors, that constitutes child sexual abuse material, or that otherwise sexualizes or is harmful to any minor.
• No abusive or harmful content. Create, generate, or distribute content that is defamatory, libelous, fraudulent, deceptive, harassing, threatening, abusive, hateful, or that incites or promotes violence, self-harm, terrorism, or unlawful discrimination against any individual or group.
• No reverse engineering or competing use. Reverse engineer, decompile, disassemble, or otherwise attempt to discover, extract, or replicate the source code, underlying models, model weights, or training data of Atlas; or use Atlas or any Output to develop or train a competing product, model, or service.
• No abuse of access. Access or use Atlas through automated means (such as scraping, bots, or crawlers) other than as expressly permitted; or circumvent, or attempt to circumvent, any rate limits, usage limits, access controls, security measures, content filters, or safety mechanisms.
• No interference. Introduce or transmit any malware, virus, or other harmful code, or otherwise interfere with, disrupt, overburden, or impair the integrity, security, or performance of Atlas or its underlying infrastructure.
• No misrepresentation. Misrepresent the origin of Output, including by presenting Output as human-generated where that would be deceptive or is prohibited, or by impersonating any person or entity.
• No high-risk reliance. Use Atlas or any Output as the sole basis for decisions or actions that have legal, financial, medical, safety, or similarly significant consequences, or in any high-risk context, without appropriate independent human review and verification.

Enforcement. Pocket FM may, but is not obligated to, monitor, review, screen, filter, restrict, or remove any Input or Output, and may investigate suspected violations of this Acceptable Use Policy and report them to law-enforcement or other authorities. Violation of this Acceptable Use Policy may result in suspension or termination of your access under Section 14, together with any other remedies available to Pocket FM at law or in equity.

11. AI Output Disclaimer

11.1 Generative AI; possible inaccuracy. Atlas relies on generative artificial intelligence. Output may be inaccurate, incomplete, offensive, or otherwise unreliable, and may not faithfully convey the meaning, tone, nuance, cultural context, register, or intent of your Input. Translations and adaptations may contain errors, mistranslations, omissions, additions, or culturally inappropriate or sensitive content.

11.2 Not professional advice. Output is provided for general purposes only and is not legal, financial, medical, professional, or other specialized advice. Do not rely on Output as a substitute for advice from a qualified professional.

11.3 Your responsibility. You are solely responsible for reviewing, verifying, editing, validating, and exercising independent judgment over the Output before any use, reliance, publication, or distribution, and for all consequences arising from your use of Output. Where appropriate, obtain qualified human or professional review.

12. Intellectual Property in Atlas

12.1 Ownership of the Service. Atlas and all associated software, models (or the rights to use them), algorithms, technology, user interfaces, designs, text, graphics, and look and feel, together with all related intellectual-property rights, are and remain the exclusive property of Pocket FM and/or its affiliates. Except for the limited right to access and use Atlas in accordance with these Atlas Terms, no rights are granted to you in or to Atlas.

12.2 Trade marks. "Pocket FM" and "ATLAS by Pocket FM" the associated names, logos, and marks are trademarks of Pocket FM or its affiliates. Nothing in these Atlas Terms grants you any right to use them without Pocket FM's prior written consent, even if the same such marks appear in your Output.

12.3 Reservation of rights. All rights not expressly granted to you in these Atlas Terms are reserved by Pocket FM and/or its affiliates.

13. Service Availability and Changes

Pocket FM may modify, update, suspend, limit, or discontinue Atlas or any part of it (including supported locales and features), and may impose or change usage limits, at any time and at its sole discretion, with or without any notice to you. Atlas may contain errors or defects and may not operate as intended. To the maximum extent permitted by law, Pocket FM is not liable to you for any modification, suspension, limitation, or discontinuation of Atlas, or for any unavailability of Atlas or loss of any Input or Output.

14. Suspension and Termination

14.1 By Pocket FM. Pocket FM may suspend, restrict, or terminate your access to Atlas at any time, with or without notice, for any reason, including if Pocket FM reasonably believes that you have violated these Atlas Terms, the Pocket FM Terms, the Acceptable Use Policy, or any applicable law, or in order to protect Atlas, its users, third parties, or Pocket FM; or comply with applicable laws.

14.2 Effect of termination. Upon termination or suspension, your right to access and use Atlas immediately ceases. The provisions that by their nature should survive, including Sections 6 (Your Content), 7 (Sample Scripts), 8 (Data Use), 9 (Feedback), 11 (AI Output Disclaimer), 12 (Intellectual Property), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Indemnification), 18 (Governing Law), and 20 (Miscellaneous), will survive termination.

15. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ATLAS, THE SAMPLE SCRIPTS, AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. POCKET FM AND ITS AFFILIATES AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES REGARDING ACCURACY, RELIABILITY, QUALITY, OR AVAILABILITY, OR THAT ATLAS OR ANY OUTPUT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. POCKET FM DOES NOT WARRANT THAT ANY OUTPUT WILL BE ACCURATE, COMPLETE, ORIGINAL, OR NON-INFRINGING.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH AN EVENT, SUCH WARRANTIES ARE LIMITED TO THE MINIMUM SCOPE AND SHORTEST DURATION PERMITTED BY APPLICABLE LAW.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL POCKET FM OR ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO ATLAS, ANY INPUT OR OUTPUT, OR THESE ATLAS TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF POCKET FM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF POCKET FM AND ITS AFFILIATES ARISING OUT OF OR RELATING TO ATLAS AND THESE ATLAS TERMS WILL NOT EXCEED USD 100.

NOTHING IN THESE ATLAS TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

17. Indemnification

You agree to defend, indemnify, and hold harmless Pocket FM and its affiliates, and their respective officers, directors, employees, agents, and licensors (the "Indemnified Parties"), from and against any and all claims, demands, suits, actions, proceedings, investigations, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable attorneys' and legal fees) arising out of or relating to: (a) your Input; (b) your access to or use of Atlas or any Output; (c) any content you submit, generate, or otherwise make available using Atlas; (d) your breach or alleged breach of these Atlas Terms, the Pocket FM Terms, or the Acceptable Use Policy; and (e) your violation of any applicable law or of any right of any third party.

Pocket FM reserves the right, at your expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with Pocket FM's defence of that matter. You will not settle any such matter without Pocket FM's prior written consent. This indemnification obligation survives termination of these Atlas Terms and your use of Atlas.

18. Governing Law and Dispute Resolution

These Atlas Terms, and any dispute or claim arising out of or relating to them or to Atlas, are governed by and construed in accordance with the laws of Republic of India, without regard to its conflict-of-laws principles.

You hereby submit to the exclusive jurisdiction of the Courts at Bengaluru, Karnataka. It is clarified that no dispute arising under this Agreement shall be referred to any association, guild, or union for settlement.

19. Changes to These Atlas Terms

Pocket FM may update or modify these Atlas Terms from time to time. Changes are effective when the updated Atlas Terms are posted or as otherwise indicated. Where required by law, Pocket FM will provide notice of material changes. Your continued access to or use of Atlas after the updated Atlas Terms take effect constitutes your acceptance of them. If you do not agree to the updated Atlas Terms, you must stop using Atlas. Please review these Atlas Terms periodically.

20. Miscellaneous

20.1 Entire agreement. These Atlas Terms, together with the Pocket FM Terms, the Atlas Privacy Notice, and any other policies expressly incorporated, constitute the entire agreement between you and Pocket FM regarding Atlas and supersede any prior or contemporaneous understandings regarding Atlas.

20.2 Severability. If any provision of these Atlas Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

20.3 No waiver. Pocket FM's failure to enforce any provision is not a waiver of its right to do so later. Any waiver must be in writing to be effective.

20.4 Assignment. You may not assign or transfer these Atlas Terms, or any rights or obligations under them, without Pocket FM's prior written consent. Pocket FM may freely assign or transfer these Atlas Terms. These Atlas Terms bind and benefit the parties and their permitted successors and assigns.

20.5 No third-party beneficiaries. Except for the Indemnified Parties and Pocket FM's affiliates and licensors (who are intended beneficiaries of the provisions that protect them), these Atlas Terms do not create any third-party beneficiary rights.

20.6 Force majeure. Pocket FM is not liable for any delay or failure to perform resulting from causes beyond its reasonable control.

20.7 Headings. Headings are for convenience only and do not affect interpretation.

20.8 Notices. Pocket FM may provide notices to you through Atlas, by email, or by posting within the Service. You may contact Pocket FM as set out in Section 21.
